Legislation

2026 Legislation

ESHB 2229 was passed by the Legislature which amended Chapter 18.43 RCW.

Additional amendments include:

  • Removal of obsolete dates
  • Language update to reflect the current processes of the agency
  • Amending RCW 18.43.033 to change the number of pro-tem appointments from two to three and allowing the board director to appoint an on-site wastewater treatment system designer, licensed under Chapter 18.210 RCW as a pro-tem board member. Current language only allows licensees under Chapter 18.43 RCW to be pro-tem board members.
  • Removing the definitions for “engineer” and “land surveyor” (RCW 18.43.020) and putting the word “professional” before “engineer” and “land surveyor” throughout the Chapter
  • Amending RCW 18.43.040 to allow the Board to decouple the experience requirement for licensure from the requirements for taking the principles & practices (PE or PLS) examinations. Experience requirements would still have to be met before applicants could apply for a license.
